Self Employment Contract

Probationary Period
Six Months – May be extended if necessary.

Newcareroots Ltd reserves the right to terminate your employment at any point after the first month of your probationary period by giving statutory notice if you fail to meet the working standards set by Newcareroots Ltd.

Any absences during the probationary period will be added when calculating the end date of the probationary period.

Disclosure and Barring Service (DBS Checks)
Your employment with Newcareroots Ltd is conditional upon receipt of a satisfactory enhanced DBS check.

As a self-employed subcontractor, you should have an online updated DBS. If you do not hold a certificate, you give consent to Newcareroots Ltd obtaining a new DBS on your behalf. An electronic result will be sent to Newcareroots Ltd before the certificate is printed. By signing this agreement, you also agree to these terms.

You must cooperate fully with the application process to obtain future DBS checks, as required, typically every three years. However, Newcareroots Ltd reserves the right to request an updated DBS check at any time during this period.

The subcontractor agrees to meet the cost of obtaining this check.

It is a condition of your employment that you notify your manager immediately if you are arrested by the police, charged, cautioned, or convicted in connection with any criminal matter.

It is also a condition of your employment to notify your manager immediately if you are suspended from work by any other employer under provisions aimed at protecting vulnerable children and adults.

You will be required to comply with any reasonable request made by a client of Newcareroots Ltd aimed at promoting the safety and security of children and vulnerable adults. Any breach of these conditions could result in action under the disciplinary procedure, which may lead to termination of your employment.

Salary
£11 per hour on weekdays and £12.50 per hour on weekends. These pay rates may vary depending on the location and responsibilities during your shift. As you are self-employed, Newcareroots Ltd will not pay holiday pay, sick pay, or employer contributions towards a work-related pension.

Mileage and Travel
Mileage may be paid depending on the distance of the journey to and from the workplace. However, you must hold a valid business insurance policy on your car. Without this, you will be unable to claim for travel.

Frequency of Payment
Weekly by BACS

Hours of Work
This contract is zero hours per week, and workplaces and hours may vary. Newcareroots Ltd will not be liable to pay you if no hours are offered or if you are unavailable to work. Shifts will be booked based on your availability. You can work as little or as often as you prefer. You also agree to work outside normal working hours, including evenings, weekends, and bank/public holidays as required.

Invoicing
It is your responsibility to send a weekly invoice with your timesheets to Newcareroots Ltd for hours worked. This must be submitted by midday every Monday for the previous week.

Mandatory Training
It is your responsibility to keep all mandatory training up to date. If not completed, you will be required to do so before the contract can begin.

Booking of Shifts
Shifts will be booked based on your availability. You can book shifts with our office staff by phone, email, SMS, or using our application. Bookings are on a first-come, first-serve basis. Provide your availability as soon as possible to secure preferred shifts. Using our application, you can enter available dates and preferred shift times.

Unauthorized Absences
If you fail to show up to work without notifying your manager or local office, you may be charged the full shift cost as compensation to the client. All sickness and cancellations must be reported to the local office and/or your manager.

Deductions
You agree that Newcareroots Ltd has the right to deduct from your salary or other payments due to you (or, if appropriate, from any payment in lieu of notice) any sums you owe the Company, including advances on pay, training agreements, overpayments, outstanding fines, or disallowed expenses.

Bank Holidays
Bank holidays are defined as: Good Friday, Easter Monday, two May bank holidays, one August (Summer bank holiday), Christmas Day, Boxing Day, and New Year’s Day.

Given the nature of the business, you may be required to work on these bank holidays. You will receive an enhanced wage, typically 1.5% to 1.9% of your normal hourly rate, depending on the client.

Sick Pay Provisions
As a self-employed subcontractor or limited company holder, you are not entitled to sick pay.

Notice Periods
The subcontractor agrees to give the following notice:

  • Up to one month: One week
  • After one month: Two weeks

The employer agrees to give the following notice:

  • Under one month: None
  • Over one month: One week
  • After probationary period: Two weeks

By mutual agreement, these notice periods may be waived. Newcareroots Ltd reserves the right to terminate this agreement without notice or payment in lieu of notice in cases of gross misconduct.

Disciplinary and Dismissal Procedure
This procedure is detailed in Newcareroots Ltd’s Company Policies and Procedures and Company Handbook. The Disciplinary and Dismissal Procedure and appeal procedure do not form part of your contract of employment.

Changes to Contract
Newcareroots Ltd reserves the right to make reasonable changes to terms and conditions of employment. Minor changes will be communicated via general notice to all employees/subcontractors, effective from the notice date. Significant changes will be notified in writing with the greater of statutory or contractual notice. You will be deemed to have accepted changes unless you object in writing before the notice period expires.

Grievance Procedure
Any grievances must be submitted in writing to your manager and will be addressed appropriately based on the details provided.

Other Employment
While employed with Newcareroots Ltd, you agree not to work for another agency at the same client premises. If you work regularly or occasionally with one of our clients through Newcareroots Ltd, you will not take shifts at those premises through another company to protect all parties involved, as liability may fall to the wrong employer.

 

Agreement for Extra Working Hours

A signature is only required if I choose to waive my rights under the Working Time Regulations, which is entirely my choice.

Data Protection

Data Protection
The subcontractor agrees that Newcareroots Ltd will keep personal information about them and discuss such information only on a need-to-know basis as required, in both paper and electronic form. You consent to having some details shared with clients for work-related purposes, including a photograph and relevant details about your skills, experience, training, and DBS status. No sensitive data will be shared with third parties unless you provide one week’s written notice to your manager to release this information. By signing this agreement, you consent to the processing of information held by Newcareroots Ltd about you, including sensitive data such as sickness and health records, ethnic origin, and trade union membership/non-membership, in compliance with the Data Protection Act 2018.

Termination of Contract
The subcontractor agrees to return any Newcareroots Ltd property upon termination, including uniforms and ID badges.

Approaching Clients
The subcontractor agrees not to approach any Newcareroots Ltd client they have worked with during their employment. Upon leaving Newcareroots Ltd, you may not seek employment with any client for six months after termination. An introduction fee of £380 will be charged for any employment obtained with a client to cover expenses incurred by Newcareroots Ltd during your employment.

Pension
As a subcontractor, you will not be automatically enrolled in a workplace pension. However, you may opt to begin a personal pension.

Confidentiality
As a subcontractor, you have a personal responsibility to protect and maintain the confidentiality of client and Newcareroots Ltd information. You must not disclose confidential information related to Newcareroots Ltd, its business, or its clients during or after your employment, except in the proper course of your duties or as required by law. This includes salary information and matters discussed in confidence with your manager.

Any documents or tangible items containing confidential information must not be removed from Newcareroots Ltd premises without authorization and must be returned upon request or termination of employment.

 

Confidentiality Statement
I understand that all matters of a confidential nature involving Newcareroots Ltd, its clients, and patients must be treated with the strictest confidence at all times, including after my employment. I understand that any breach of confidentiality may result in dismissal without payment in lieu of notice and, after employment, may lead to legal action.
